In order to safeguard the effectiveness of legitimate communications, Kosher Email enforces a strict Anti-SPAM policy across all its services. Unsolicited emails, often referred to as “SPAM,” are strictly prohibited. Any use of Kosher Email’s platform to send emails without prior consent of the recipient is a violation of our Terms of Service and will not be tolerated.
Proper Use of Kosher Email Services
Kosher Email’s solutions are designed to strengthen and facilitate communication between businesses and their clients, leads, and partners. Clients must exercise responsible business practices when using our services. Customers are fully responsible for the content they send and the mailing lists they use.
Kosher Email routinely monitors activities to ensure strict adherence to our Terms of Service. In the event of any SPAM complaints, an investigation will be conducted. Should a customer be found in violation, Kosher Email reserves the right to immediately terminate the customer’s account and pursue legal action where necessary.
What Constitutes Unacceptable Use
An email will be classified as SPAM if any of the following apply:
– The mailing list is not fully based on opt-in consent.
– Email addresses were obtained through harvesting, purchased lists, third-party sources, or any means other than direct, voluntary subscription.
– The “From” or “Reply-to” email addresses are invalid.
– Messages lack a clear and easy method for recipients to unsubscribe.
Note: Every email sent via Kosher Email automatically includes an unsubscribe link. Any individual who opts out will be promptly and automatically removed. Customers are not permitted to bypass or override these system functions. Misuse of Kosher Email’s services for SPAM may lead to severe legal penalties.
Prohibited Content and Activities
Clients must not use Kosher Email to send, promote, or link to content that involves:
– Intellectual property infringement (copyright, trademark, trade secrets).
– Harassment, abuse, defamation, or threats.
– Adult material, including pornography, explicit content, or extreme violence.
– Pyramid schemes, gambling, lotteries, or raffles.
– Collection or exposure of personal information regarding minors under the age of 13 without verified parental consent.
– Promotion or sale of controlled substances, illegal products, weapons, pirated software, or other unlawful goods.
– Any activity involving reverse engineering, tampering with Kosher Email’s platform, or unauthorized duplication of Kosher Email’s technology.
Legal Compliance Responsibilities
Each customer must ensure compliance with all relevant laws, including but not limited to:
– The CAN-SPAM Act of 2003 (U.S.)
– The Children’s Online Privacy Protection Act (COPPA)
– GDPR (General Data Protection Regulation, where applicable)
If complaints are received regarding unsolicited emails, Kosher Email may suspend the customer’s account until a full reconfirmation of their mailing list is completed. No refunds or fee reductions will be granted during such suspension.
In cases where SPAM practices are confirmed, Kosher Email reserves the right to seek injunctive relief and to recover any financial damages incurred.
